The Second Amending Law of the
Union Civil Service Board Law
(2019, The Pyidaungsu Hluttaw Law No. 14)
The 14 Waxing of Kasone, 1381 M.E.
(17 May, 2019)

The Pyidaungsu Hluttaw hereby enacts this Law.
1. This Law shall be called the Second Amending Law of the Union Civil Service Board Law.

2. Sub-section (g) shall be inserted after sub-section (f) of section 2 of the Union Civil Service Board Law as follows:
“(g) Ministry and Organization means ministries and organizations as defined in the Union Civil Service Personnel Law.”

3. Section 3 of the Union Civil Service Board Law shall be substituted as follows:
“3. This Law shall apply to all civil service personnel of each ministry and organization except civil service personnel mentioned in sections 291 and 292 of the Constitution.”

4. In section 8 of the Union Civil Service Board Law,

  • (a) Sub-section (d) shall be substituted as follows:
    “(d) conducting research on service personnel affairs;”
  • (b) Sub-section (d-1) shall be inserted after subsection (d) as follows:
    “(d-1) surveying public opinion on the service provided by service personnel and conducting research on it”
  • (c) Sub-sections (f) and (g) shall be substituted as follows:
    “(f) scrutinizing the matters of service personnel when requested by ministries and organizations, and replying to them in accordance with the existing law, rules, regulations and procedures;”
    “(g) maintaining records of taking action against service personnel systematically and reporting it to the President;”
  • (d) sub-sections (g-1), (g-2) and (g-3) shall be inserted after sub-section (g) as follows:
    “(g-1) scrutinizing other requirements including whether work experience of the gazette officer matches the nature of work in the department where such officer is to be transferred upon the request for transferring a gazette officer from a ministry or organization to another, and reporting the findings to the Union Government;”
    “(g-2) recommending organizational structures developed and submitted by ministries and organizations to the Union Government;”
    “(g-3) supporting ministries and organizations in developing competency frameworks and job descriptions according to different positions of civil service personnel;”
  • (e) Sub-sections (h) and (i) shall be substituted as follows:                                                                                                                                                                                                                                                       (h) “scrutinizing the matters on the selection and training of service personnel, and the maintenance of discipline in ministries and organizations, and coordinating with them;”
    (i) “forming civil service personnel organizations and appointing necessary civil service personnel in accordance with the Civil Service Personnel Law for enabling the Region or State Government to perform their duties, in coordination with the Union Government in advance;”
  • 5. In the Union Civil Service Board Law,
  • (a) the introduction of section 9 shall be substituted as follows:
    “9. The powers of the Board relating to appointment and promotion of service personnel are as follows:”
  • (b) Sub-sections (b) to (f) shall be substituted as follows:
    • (b) specifying selection of civil service personnel for the remaining positions to be selected by the relevant ministries and organizations other than those to be selected only by the Board;
    • (c) delegating the task to the heads of ministries and organizations or heads of service personnel organizations to form a body and select service personnel for the remaining positions other than those to be selected only by the Board;
    • (d) instructing the heads of service personnel organizations of the Region or State to appoint service personnel mentioned in sub-section (i) of section 8 in accordance with the directives of the Board subject to the provisions in sub-section (h) of section 8, if required;
    • (e) recommending the appointment of service personnel to any position in any ministry and organization to the Union Government if it is necessary due to any unusual circumstance;
    • (f) scrutinizing the matters on the promotion of service personnel to gazetted officers recommended by the relevant ministry and organization in accordance with the stipulations for promotion as set forth in the Civil Service Personnel Law and Rules.”

6. In section 10 of the Union Civil Service Board Law,

  • (a) sub-section (d) shall be substituted as follows:
    • “(d) cooperating with the respective ministries and organizations on departmental proficiency training courses for their service personnel in accordance with the adopted training policies for civil service personnel.
  • (b) sub-section (e) shall be inserted after subsection (d) as follows:
    • “(e) training effectively the proficient service personnel according to their positions to appoint them deservedly in the posts of Senior officials and heads of ministries and organizations.

7. Sections 12 and 13 of the Union Civil Service Board Law shall be substituted as follows:

  • “12. The Board may request for assistance from the ministries and organizations or experts if the technical assistance is required in performing its duties.”
  • “13. The Board may request for necessary personal data of service personnel from the relevant ministries and organizations.”
